How Do I Get Driving Privileges?
Unfortunately, there are many ways your license may be suspended if you are charged with a DUI or as it is called in Ohio, an OVI. Typically a license suspension begins with the imposition of an Administrative License Suspension (ALS). This is an automatic suspension that is imposed if you either refuse a breath test, Urine Test or Blood Test OR if you submit to a chemical test and the result is over the legal limit. Depending on the Court and the Judge driving privileges may be obtained by a written motion, or by a hearing.
When Can I GetDriving Privileges?
The short answer is it depends. Typically on a first OVI-DUI you are eligible for driving privileges 15 days after you are charged if you submitted to a chemical test and 30 days after you are charged if you refused a chemical test.
What Kind of Driving Privileges Can I Get?
Driving Privileges are discretionary which means a judge can grant you any privileges they determine appropriate. Typically this includes driving privileges for work, school or medical purposes. Many judge will also grant you privileges to drive for household errands.
What is Interlock?
Interlock is short for an inition interlock device. This a device that is installed in your vehicle. You are required to blow in this device. If alcohol is detected in your breath, your car will not start and the court will be notified of the violation.
Will I have to get the Interlock Device?
It depends on the facts of your case and your prior record. Sometimes we can use the interlock device as a mechanism to shorten the mandatory license suspension and to keep the Judge from imposing any jail time, by utilizing Annie’s Law.
