What You Should Know
Types of Custody:
Sole Custody: One parent is granted exclusive legal and physical custody of the child.
Shared Parenting (Joint Custody): Both parents share legal and/or physical custody. This doesn't necessarily mean equal time with the child, but rather a shared responsibility in making major decisions for the child's welfare.
Determining Custody:
Ohio courts consider various factors to determine what is in the best interest of the child. These include the wishes of the parents and the child (if the child is mature enough), the child's interaction and relationship with parents and others, the child's adjustment to home, school, and community, the mental and physical health of all parties involved, and whether either parent is more likely to honor and facilitate court-approved parenting time rights or visitation and companionship rights.
Parenting Plan:
Parents are encouraged to create a parenting plan that outlines how they will share time and make decisions for their child. If parents cannot agree, the court will establish a plan.
Modification of Custody:
Custody orders can be modified if there is a significant change in circumstances impacting the child’s best interests.
Visitation Rights:
In Ohio, the term "parenting time" is often used instead of "visitation". Non-custodial parents are typically granted significant parenting time unless it's deemed detrimental to the child.
Role of Child’s Preference:
